Sectional Title Schemes
Do you live in a complex, estate, village or apartment? These facilities offer many lifestyle benefits. They are convenient, and safe. By their very nature this means that living in a community brings with it both benefits and responsibilities.
Living in a sectional title scheme is a lot different than living in a stand alone home. Sectional title schemes are governed by the Sectional Title Schemes Management Act, 2011 and its Regulations 2016, commonly referred to the STSMA.
The STSMA prescribes how schemes are run. Every owner in a sectional title scheme is automatically a member of the body corporate. The body corporate is responsible to run the complex, estate, village or block of flats. In order to do so each body corporate must have rules and must also appoint trustees who are responsible for the day to day running and management of the scheme for the benefit of all concerned. All operational costs must be shared amongst all the owners proportionate to the size of the unit they own and this must be collected monthly by means of a levy.
There are huge complexities and legal responsibilities in running a sectional title scheme. Trustees have limited powers and can only make decisions within those powers, all other decisions must be taken by resolution at a general meeting. Ordinary resolutions can be taken by vote number but special and unanimous resolutions must be taken by PQ and number. A quorum based on PQ determines the validity of the meeting. Managing this to ensure the requirements of the STSM Act and Regulations are met is difficult. We have developed an easy to use software programme that does this easily and automatically for you.
